    Who can refer the Committee?

The law allows the complaint to be filed by the person who considers themselves the victim of the malpractice act or their legal representative and, in the event of death, by the successors of the person. (Legislation)

    What we prepare before filing

I would not send just a general complaint.

I build a clear chronology of the medical act and select the relevant documents: medical file, investigations, informed consent, documents on subsequent evolution and any other necessary evidence.

Is it mandatory to go to the Committee first?

No. The Committee procedure does not prevent the court from being seized under ordinary law. The choice of route must be made according to the existing evidence and the concrete objective of the case. (Legislation)

If the main objective is to obtain sums for the damage suffered, see Medical malpractice compensation.

Can the Committee's decision be challenged?

Yes. The law provides for a 15-day deadline from the communication of the decision to challenge it before the competent court. (Legislation)

Have you already received the decision? Send me the document as soon as possible to check the deadline and available options.

    Frequently asked questions

    1. How long does the Malpractice Committee procedure take?

The law provides deadlines for appointing experts, preparing the report and issuing the decision. The exact duration may vary depending on the complexity of the case and the administrative authority involved.
    2. Does the Malpractice Committee also decide on compensation?

No. The Committee establishes whether or not there was malpractice. Compensation can be obtained through civil proceedings, and we analyse the strategy for this aspect separately.
    3. What do I do if the Committee's decision is unfavourable?

The decision can be challenged within 15 days of communication. I analyse the report, the grounds and the expert reports to build the challenge.
