    What art. 335 of the Criminal Code provides

    Driving a vehicle on public roads, where a licence is mandatory, by a person who does not hold such a licence is an offence under art. 335 (1) of the Criminal Code.

    The text also punishes driving with a licence that does not correspond to the vehicle category, as well as driving while the right to drive is suspended or the licence has been withdrawn or annulled.

    Entrusting a vehicle to a person in one of these situations is also punishable.

    Suspended licence: when the measure takes effect

    The suspension of the right to drive takes effect at the moment provided by law, and communication of the measure is essential.

    If at the time of the stop the measure had not been communicated or had not yet taken effect, the elements of the offence may be missing.

    Vehicle category and the notion of public road

    Not all vehicles require a licence, and some categories have special rules. I check the concrete classification of the vehicle driven.

    The offence also requires driving on a public road. Manoeuvres in a private area not open to public traffic are analysed differently.

    State of necessity and mistake
