Assault and bodily harm: what difference it makes
Art. 193 of the Criminal Code sanctions assault and other violence, while art. 194 sanctions bodily harm. The difference lies in the severity of the consequence: days of medical care, disability, serious and permanent aesthetic prejudice, miscarriage or danger to life.
The classification also determines the procedure: for assault, prosecution starts upon the prior complaint of the injured person, and reconciliation removes criminal liability.
This distinction directly influences the level of compensation that can be obtained.
The forensic report and the days of medical care
The forensic certificate is obtained from the forensic medicine institution as soon as possible after the injuries occur, so that they can be observed directly.
The number of days of medical care is not the length of sick leave, but the time medically necessary for healing.
If the initial assessment does not reflect the real situation, a new expert report or a supplement to the conclusions can be requested, with clear objectives.
How moral damages are established
Moral damages are not calculated with a formula. The court analyses the intensity of the suffering, the length of treatment, the sequelae, age, professional activity and how your life has changed.
A visible aesthetic prejudice, a disability or the impossibility of resuming previous activity justify significantly higher amounts.
Supporting these elements with concrete evidence, not only with statements, makes the difference between a symbolic sum and real compensation.
